AGU releases janja performance, but requires transparency on agenda and official expenses

The Attorney General of the Union (AGU) released this Friday, 4, opinion that will guide the performance of the spouse of the presidents of the Republic. The document was made at the request of the Lula Civil House after criticism of spending involving the first lady Rosângela da Silva, Janja.

The AGU recognizes that the spouses are entitled to “public interest” acting and says that its function must be voluntary and unpaid. And that there must be the provision of travel accounts and use of public resources related to the spouse and their team.

The opinion recommends the disclosure of the public commitment agenda on an official website, as well as the expenses and trips through the Transparency Portal.

“The president’s spouse, in his performance of public interest, presents his own legal nature that stems from the civil bond maintained with the head of state and government. Thus, the spouse plays a symbolic representative role of social, cultural, ceremonial, political and/or diplomatic in the name of the president,” says AGU.

The text says that the performance of the spouse is based on the principles of public administration – legality, impartiality, morality, publicity and efficiency. It provides for the analysis, on a case by case basis, “the eventual incidence of constitutional or legal restriction on access to information, in situations where there is a need to safeguard the security and/or intimacy of the presidential spouse”.

The opinion should guide the performance of the first lady Rosângela da Silva, Janja, whose presence in international events and lack of transparency in the spending of her team have been the subject of criticism.
