The São Paulo Court has determined that Councilman Alexandre Frota (PDT) and Facebook remove a video posted on social networks that exposed a doctor during an inspection made by the politician at UPA Atalaia, in Cotia, Greater São Paulo.
Judge Renata Pedreno, responsible for the decision, understood that the doctor Carolina Crespilho, who appears in the images, was disrespected and had her image exposed without authorization.
The decision, issued on Friday (4), establishes a daily fine of R $ 50 thousand, limited to R $ 500 thousand, if the court order is not fulfilled. The magistrate also banned fleet from publishing new posts about the episode – even indirectly – under penalty of a new fine.

“I determine the abstention of the defendant Alexandre Frota de Andrade to make new posts in any platforms, mentioning the plaintiffs, albeit transversely,” wrote the judge.
Filmed and criticism of the doctor
The video was published on the official Facebook fleet page last Wednesday (2), under the title: “Inspection at UPA Atalaia!” In the recording, the councilman claims to have identified sleeping doctors, as well as lack of medicines and air conditioning in the unit. He appears in the hospital accompanied by advisors with t -shirts printed with the inscription “parliamentary inspection”.
During the shoot, the doctor asks the councilman to withdraw, claiming that he would be disrespecting health professionals. Fleet replies that, being an elected councilor, he has the right to conduct surveys in public offices. The recording was taken down on Monday (7).

The judge pointed out, in its decision, that “any inspections must occur respectfully, without intimidation to local workers with recordings.”
In an response published on Instagram, Alexandre Frota stated that he has not yet been officially notified of the court decision, but will comply with the order as soon as it is summoned. “A friend called me saying that she read that the judge would have given a court order to remove the video. I have not yet been notified. When I go, I retire the video.
The defense of the doctor claims that there was abuse of authority and violation of imaging rights.
