PM soldier is punished with two days in prison after posting video washing vehicle

A soldier of the Ceará Military Police (PM-CE) was punished with two days in administrative arrest because of two videos posted on social networks in April and June 2023. In one of them Mayara Kelly Gomes Silva appears washing a corporation car. In another, it teaches how to apply a tourniquet (device applied to injured limbs to contain bleeding).

The soldier’s defense said he had received the decision, classified as a “misconception”, and appealed from the punishment. It also points out that the episode represents “breach of isonomy”, since, he argues, male police officers have already made similar videos and yet they would not have been punished. Already the PM of Ceará states that the inquiry allowed broad defense.

In the inquiry, obtained by Estadãothe PM-CE Subcommand states “that although the principle of freedom of expression ensures to individuals the right to maintain personal profiles in social networks, the use of official uniforms, as well as the exposure of vehicles and other characteristic elements of military police activity, constitutes a clear representation of the Ceará Military Police Institution (PMCE)”.

The corporation adds that these institutional symbols should not be used “in particular publications without proper authorization, under penalty of affecting the necessary discipline and decorum that govern military activity.” The inquiry was completed on the 26th.

In both recordings, published in a personal account of PM-CE soldier on Instagram, Mayara Kelly, from the 1st Company of the 11th Military Police Battalion, uses the PM uniform and appears on the premises of the barracks. The soldier today has 41,000 followers on the social network.

‘Intention to motivate other women’

Mayara Kelly stated during the inquiry that “made the videos with the intention of motivating other women who want to work in the police” that her social network is not monetized and who had already been called to the corporation’s command to talk about publications on her social network.

In the video in which she appears washing the car, for example, she states that “some people think the woman in the police only works in the administrative”, but adds that they perform “countless functions that even years ago could be considered only things for man.”

For the subcommand, the policeman herself recognized “to have been previously guided by the PM-CE command about the content of her social network publications, which denotes prior science about the inadequacy of such conduct, without changing behavior later.”

The document points out that, despite the decision, Mayara Kelly has been praised over the years for good services provided. She joined the corporation in October 2017, in the career of square. It also points out that, in its functional trajectory, there are no records of relevant disciplinary offenses that may harm their professional conduct, as well as a rebuke in 2024.

Sought by Estadãolawyer Francisco Sabino, who represents Mayara Kelly Gomes, said that “he received with surprise the decision of administrative punishment” of two days of disciplinary stay, “when the military should be quartered, far from her family and two minor children (10 months and 06 years old) who need their care”.

According to him, the understanding that the police would have transgressed disciplinary norms is “an interpretative misconception and excess of rigor.”

“Highlight that the video in which the police teach her followers how to make a tourniquet, in fact, it is a video of public utility, since the intention is merely educational informative and departed from its own experience of the military, who has a military police brother, who was hit by firearm while acting against organized crime,” he says.

In Sabino’s assessment, “the contents disclosed report the professional routine of the military, they do not have a sensitive technical or administrative nature, nor caused damage or have significant potential to cause dismay, damage to the corporation.”

“The defense reaffirms the innocence of military police Mayara Kelly Gomes, and yesterday (8) filed an administrative appeal to the command of the corporation, requesting the annulment of punishment, requiring that sense of justice command,” says the lawyer.

In a statement, the Command of the Ceará Military Police states that the inquiry in question, which culminated in a disciplinary sanction of the soldier, “had broad defense and contradictory, and still has a deadline for appeal, all provided for in the Disciplinary Code.”
